A Debt Against the Living: An Introduction to Originalism, by Ilan Wurman

Review

'Ilan Wurman's fine book explores a classic question about constitutions, especially written constitutions, and most especially ours: Why should people in later generations feel bound by rules put in place by people in earlier generations? Wurman has provided a careful, detailed, and properly nuanced argument for James Madison's suggestion that the constitutional order gives rise to a kind of 'debt' that the living have to the dead - an argument that illuminates many current questions in constitutional law.' Robert P. George, McCormick Professor of Jurisprudence and Director of the James Madison Program in American Ideals and Institutions, Princeton University, New Jersey'This is a wonderful book, and a major contribution to the academic and popular discourses on originalism.' Randy E. Barnett, Carmack Waterhouse Professor of Legal Theory and Director, Center for the Constitution, Georgetown University Law Center, Washington, DC and author of Our Republican Constitution: Securing the Liberty and Sovereignty of We the People'Ilan Wurman's book is more than an excellent introduction to constitutional originalism. It is also an argument for the importance of an enduring constitution - a work of popular sovereignty that protects rights, enables democracy, and bestows its benefits on future generations.' Jack Balkin, Knight Professor of Constitutional Law and the First Amendment, Yale Law School, and author of Living Originalism'The confirmation hearing of Justice Neil Gorsuch brought the debate over an originalist approach to constitutional interpretation before the public like never before. Ilan Wurman's timely book provides the lay reader with a clear and lucid explanation of what originalism means, and a thoughtful and inspiring defense of why the Constitution remains worthy of our allegiance today.' Ralph A. Rossum, Salvatori Professor of American Constitutionalism, Claremont McKenna College, California, and author of Antonin Scalia's Jurisprudence and Understanding Clarence Thomas'Originalism is one of the most important theories of constitutional interpretation, and yet it is often misunderstood. Ilan Wurman's explanation and defense of originalism is therefore important and timely. It is also sophisticated, accessible, and fun to read. This book should be given to every law student.' William Baude, Neubauer Family Assistant Professor of Law, University of Chicago Law School'If a written constitution is to constitute - if it is to give a durable, predictable form to government institutions and procedures - it must be consistently construed with fidelity to its words. Ilan Wurman's argument, as trenchant as it is timely, demonstrates that such originalism is, although demanding, indispensable.' George F. Will, Newspaper columnist and political commentator'Constitutional theory matters. We disagree about what our constitutional rights and powers are in large measure because we disagree about general and abstract questions of constitutional interpretation. In clear and accessible prose, Ilan Wurman defends an originalist approach to constitutional interpretation on the arresting ground that only by enforcing the written Constitution as it was originally understood by those who wrote and ratified it can living Americans discharge a debt that we owe to the Founding. Wurman's book is a lucid introduction to theoretical debates of great practical importance.' Mitchell Berman, Leon Meltzer Professor of Law, and Professor of Philosophy, University of Pennsylvania

A superb short treatment of the judicial philosophy of originalism. Highly recommend.

This book brings complicated concepts to a wide audience. For lawyers, law students, and non lawyers alike. Do yourself a favor by reading this book. It will help you understand the topic better and improve your ability to articulate an important topic.

Great concise read on Originalism. It combines history, philosophy, and law Into a great book! Highly recommended for anyone who wants a survey of Originalism and Constitutional Interpretation.

Simply fascinating, well maybe not simple. The author is anachronusm. Keep wtiting Mr Wurman.

Wurman shows that we may never be debt free from the Framers – and that’s a good thing. Subsequent generations have reaped the benefits of the Framers’ constitutional design. This book goes beyond tired clichés of originalism as the plain meaning of the text and shows that originalism is a nuanced approach that begins with trying to understand the thought of the Founders, who left many questions to be resolved by democratic politics. The book’s only shortcoming is that it is a page-turner and leaves the reader wanting more than its tightly-argued 135 pages. I hope we can read more from Mr. Wurman in the future.

I received this book as a Christmas present and was extremely pleased with it. Mr. Wurman provides an excellent introduction to Originalism which includes, amongst other things, the history of the modern theory, the various schools of thought within Originalism, and a nice overview of the founders’ constitutional philosophy. I would highly recommend this book to anyone who is interested in Originalism itself or those who just want to learn more about what makes the Constitution great!

A very readable and compelling statement for why the Constitution and our laws need to be understood by the common understanding if what the words used meant when passed into law.Much of the judicial and political turmoil the US has faced in recent decades arises from judges becoming legislators in robes, the bypassing of the legislative process of elected representatives in law making and changing it to a small and unelected group of judges who decide they’ll just replace the vote if the people because we are not as wise as they are.

This was a great short introduction to Originalism. Ilan knowledgeably addresses many of the components of the methodology in an approachable manner.

"Savoir vivre ensemble” in a multicultural context has been the author’s focus for many years. Her new book, brilliantly thought and meticulously built, is tackling this complex subject with accuracy and humor, in a smart and playful way.Full of delightful details and helpful analysis, Claude Koehl’s great storytelling resonates with my own experiences, and reminds me that diversity is such a wonderful source of inspiration.B.F. Paris

I have been in the US for 8 years now and soon after I moved here there were a lot of things that looked normal to everybody else but me. They were the things that they mentioned in this book, I wish I had someone to explain me those things like they did in this book . I highly recommend to anyone who is curious about American way is life.

I think this book is not only entertaining but could be helpful and informative for those who are on a way of discovering American cultural and life styling differences. It could be a perfect book for ESL (English as a second language) students or an informative guide for travelers. Great Job Claude Koehl.

Pretty fun and accurate, this is a great book to share with friends from other countries

When I moved to the USA in 1981 I would have loved to have access to a book like this. Many things of the American way of life were a mystery to me then (sometimes they even are now) and it would have helped to have access to a book like this to overcome the first hurdles. And doing it with a smile. This is a fantastic book. It describes all possible or even impossible situations one can run into while settling into the American way of life and does it in a funny nonderogatory way.

This book is funny, lighthearted and has great details on the American way of life. I found myself laughing at some of the topics that the author highlighted and it’s so true! Very useful book for people coming to the US and navigating through this nation of ours!

I could see myself in many of the situations described here and the book is very fun to read ! Great moment

Gothic Charm School: An Essential Guide for Goths and Those Who Love Them, by Jillian Venters

About the Author

Jillian Venters was a fairly spooky and morbid child. When she discovered the existence of the whole Gothic sub-culture, she clapped her hands with glee and fell upon it like a babybat upon a box of Count Chocula cereal. Since then, the Lady of the Manners has spent a not inconsiderable amount of time trying to gently persuade others in her chosen subculture that being a polite Goth is much, much more subversive than just wearing T-shirts with "edgy" sayings on them. She lives in Seattle.

Jillian Venters (the Lady of the Manors) presents her case for the gothic subculture in her most elegant fashion. Her book is not only entertaining and fun to read, but it is also very informative and gives the reader new and insightful information about this beloved subculture that I, a goth myself, wasn't aware of. Thank you, Lady of the Manors, for writing such a beautifully articulated book. I hope people can get their hands on this and learn what goth is and what goth isn't. Our subculture has gotten so much bad rep throughout the years and the Lady of the Manors is here to get things put straight.

I bought this book some time ago, after following Auntie Jill's blog for many years. Although I wasn't raised in an area where I knew many other goths, Jillian's writing style held my attention and educated me on the origins of the subculture. It helped me appreciate more than the fashion and general spookiness, which is what drew me to goth in the first place as a baby bat in high school. The most helpful aspect of this book, though, was the encouragement Jillian gives to embracing the cliches. Incorporating what elements of goth suit a person, and not feel like a "lesser" goth when admitting some aspects aren't for you. Greatest of all, she teaches how to be polite when faced with negative opinions and comments. Without sacrificing your own self worth and identity.I definitely recommend this book to anyone who is a part of the goth subculture- whether that be yourself, a friend, or a family member. It makes the perfect gift for anyone of any age.

Gothic Charm School by Jillian Venters is a collection of the amassed wisdom of the type that she dispenses on her blog, decorated with lovely illustrations by her husband. The Lady of the Manners, as she refers to herself, speaks in a charming style throughout the book (notable for her frequent use of the third person). Subtitled “An Essential Guide for Goths and Those Who Love Them,” Gothic Charm School is directed at a wide audience–both goths themselves and those outside the subculture who want to learn more about it. Jillian combines humor with practical advice in chapters ranging from “Dealing with roommates” to “Why friends don’t let friends dress like the Crow.”For my full review, see The Gothic Library: http://www.thegothiclibrary.com/gothic-charm-school-review-book-by-a-fellow-goth-blogger/

Absolutely fantabulous book! (Yes, I just used the made-up word "fantabulous.") If you are looking at this book, go ahead and stop looking and either buy it or borrow a copy and start reading. I personally think that this book should be on the (non-existent) Required Reading list of every young person, whether they be Goth or otherwise.Ah Jillian, where were you when I was a "babybat" in high school? Had I read this book in high school (it was published after my high school years), I believe my teen years would have been worlds easier and more enjoyable. Those were the years I vehemently denied that I was a "Goth," feeling that I was above labels (as were my fellow students, friend and foe alike) because they always carried derogatory connotations. Now, having read this book in my 20s, I found myself nodding my head in agreement with The Lady of Manners on many subjects, if not all, but particularly during her section about labels and those who are labeled "Goth" but deny they are, because they do not want to be associated with labels at all (or for whatever other reason they may have).I could sing the praises of this book for hours, I'm sure, but I'll wrap this up by saying you should read this book. No matter who are, what scene/clique/sub-culture, etc., you tend to associate yourself with, and no matter your age, I truly believe anyone could benefit from this book in some way.

Wonderful addition to my book collection. I've had a lot of questions about the Goth subculture, and this book answered a lot of questions I had. Whether you're a prospective bat baby(a new goth), a concerned parent, an Elder Goth( a long-time member of the subculture), or a curious person there's a lot to learn. The author has an easygoing style that everyone can understand and there are laughs to be had as well.

Julie Venters is amazing when it comes to explaining the Gothic culture to goths, babybats, and non-goths. Teaches how to properly respond to bullying and harassment, how to politely explain to friends and family why you are goth, how parents can have Goth children and not panic about it.... Oh, I could go on for DAYS!Perfect for anyone - even if you aren't Gothic.

This book is helpful for goths and non-goths alike. While the Lady of Manners does present some highly valuable information and advice for those who have embraced the goth lifestyle, her tips for etiquette can be applied to everyone. The title does not lie: the book spends a fair amount of time explaining aspects of the subculture for people who are not a part of it. I think every parent should pick up chapter 3 for a read. If you're looking for a handbook on how to be goth -you are wasting your time because there are no set rules. Pick up this book instead of something that claims to be gothier than thou. The Lady of Manners is fair and does not point an accusatory finger. Instead, she points you in the direction that will probably end up benefiting you the most -good manners. She does offer advice and recommendations for fashion, music, books, romance, and socializing. There is also a very important chapter covering something that every goth probably goes through: the misunderstanding of others regarding the lifestyle they (the goth) have chosen. Overall, this book is worth a read for anyone who is interested in, or is a part of the subculture.

This is great book, but mainly for high end outside, composting with large areas of land or huge built wooden composting units, etc... for the farmer or major food or land grower. It is not really for the home apartment composter with worms trying to grow and re-use soil in a garbage can for sprouts, etc..They cover a garbage can briefly, but it was not enough to go on for someone trying to get castings and soil compost working in a can in an apartment or condow. However, the book is technical and very clear on how important it is to understand soil balance and the mechanics of this related to microbes in the soil, various bugs and how all elements of nature, water, soil, minerals, metals etc... affect our soil and like blood in our body must be balanced and kept correctly balanced or plants don't grow and get nutrition and the life cycle on the earth for all living things that eat plants etc..does not work well. The importance of composting and not using pesticides and hurting the nearby lakes and fish with them and other aspects of being a real composting farmer are discussed. I still think it is very important information for any gardener or lover of the earth to know and read. Good book.

Although the bulk of the material contained in this book could be found online, it's still a worthwhile purchase. Indeed, it is a must have. The purchase price of the book will be quickly regained in the money you will save making your own compost rather than purchasing bagged compost or synthetic fertiliser.A few of the chapters are more interesting than useful to the home gardener. For instance, one of the early chapters discusses the history of composting beginning with the ancient Akkadians. The final chapter discusses managing large scale compost operations (by large scale, I mean tens and hundreds of tons of waste) on the farm or as part of a municipal waste management strategy. The core of the book, however, is very directly useful. A chapter is provided describing the chemistry of what goes on in composting, and what goes on as plants attempt to take nutrients from the soil. Another chapter describes the various types of life from microbes to insects and worms (including lovely line drawings) that inhabit a compost pile during the various phases of its lifecycle.By far the most useful chapter is chapter 6, which provides a list of potential ingredients for your pile and suggestions on how to obtain them. Numerous charts are provided that indicate on balance whether an item should be considered a "green" or a "brown", and (should you desire more specifics) the actual NPK content of various ingredients. This is fully a fifth of the book. The next most useful chapter is chapter 10, which gives suggestions for various sorts of compost bins you can buy or build. Another chapter describes tools like chippers and shredders that might be useful to you if you plan to make a fair amount of compost. Alternatives are suggested for the folks who don't need quite that much labour saving help.I can't think of anything that is not in this book that I wish it had. Nor for that matter, can I think of anything that needs to be cut from it. It strikes the perfect balance between comprehensiveness and brevity.

It's helpful so far. Be careful not to confuse this with the original.I did and bought it by mistake. Turns out to have been a happy accident.. The editors did a great job with the update. This copy was a 1992 version(newer than expected). Glad to have the real book. Rodale Press kept up standards. If you want to go to your favorite search engine and try to figure out which of the 30 different answers to same question are accurate, have fun. Rodale Press, in my opinion, remains an accurate source of information about gardening and composting. Glad to have the book. It will be a life long reference. Book came in great shape, nearly new condition.https://smile.amazon.com/dp/0878579907/ref=cm_cr_ryp_prd_ttl_sol_0

This book truly covers it all, and does so in a way which describes methods of composting in such a way as to rival hydroponics for sheer efficiency. As the heir of a home with a badly neglected yard, this book has given me more information than I'll ever be able to use. I'd go broke if I had to have all my yard cuttings hauled away... in addition, this book informs me that I'd be throwing away a fortune if I did. If you live in the Southwest, particularly in Los Angeles where there was a great deal of developing since the 1950s, then you are probably no stranger to poor hardpan soil, and you would do well to buy and read a copy of this book.On the pro side, this book goes into detail about plant nutrients without resorting to addition of chemical fertilizers (we can leave that to the hydroponics crowd), instead relying on nutrient adjustment through addition of the proper compostable materials to any given batch. There are even guidelines in here for people like my neighbor, who has expressed interest in starting his own composting operation and adding a methane recovery unit.On the con side, about the very worst I can say about this book is that there is no mention of sow bugs and armadillo bugs and the role they play in reducing large pieces of rotten wood to a good, peatlike compost; but then again, as I write this, my budget cannot accommodate the expense of a brush chipper. On the whole, I thoroughly recommend this book.

I HIGHLY recommend The Rodale Book of Composting to any and everyone who has an interest in composting. This book can be read as an in-depth text book for those who want to seriously delve into the topic. At the same time, if you have a general interest in composting, you can skim through only the pertinent parts as well. I've referred to it a great many times, as well as referred others to it as suggested gardener reading. Super, SUPER, S U P E R book. Easy to read, but at the same time highly informing.
